President of the Republic of Malawi

POLITICAL HISTORY & BACKGROUND

 

Established in 1891, the British protectorate of Nyasaland became the independent nation of Malawi in 1964. After thirty years of one-party rule under President Hastings Kamuzu Banda, the country held multiparty elections in 1994, under a provisional constitution, which came into full effect the following year.

 

 

 

THE GOVERNMENT

 

A democratically elected government was installed in May, 1994 along with a new constitution. This constitution guarantees for the Malawians their basic and fundamental freedoms and human rights. The Malawi Constitution is the primary source of law and has the status of "Supreme Law" in Malawi . The other sources of law are the "English Common Law", case law and statute law. The constitution guarantees protection of investments, irrespective of ownership. In addition, Malawi is a signatory to various international treaties. In order to enhance a favourable business environment, Malawi has further signed instruments/treaties for the protection of private property and investments including settlement of investment disputes such as: The International Centre for the Settlement of Investment Disputes (ICSID). The Multilateral Investment Guarantee Agency (MIGA) and Bilateral Investment Guarantee and Protection Agreements (BIPAs).

 

Malawi has a constitutional tricameral system of government comprising

 

  • the Executive (President, Cabinet and Civil Servants);
  • the Judiciary (Supreme Court, the Court of Appeal, the High Court and the Magistrates Court) and
  • Legislature (Parliament and members of Parliament)

The President is the executive head of government who is elected on a five-year term that also coincides with the lifespan of parliament. The President is also the Commander In Chief of the Armed Forces and the Malawi Police Service and as Executive Head of State, the President and the National Assembly form the Parliament of Malawi.

 

 

General Elections 

 

The first elections under the multiparty system took place on 17 May 1994. In 2004, Malawi held its third multi-party elections and elected President Ngwazi Dr. Bingu wa Mutharika as the Head of State.

 

The fourth multiparty presidential and parliamentary elections in Malawi were held on 19th May 2009. His Excellency Ngwazi Dr. Bingu wa Mutharika and the ruling party Democratic Progressive Party (DPP) won an overwhelming majority on both presidential and parliamentary elections.
